Hawaii Supreme Court rules against Superferry<\/h2>\n

The state Supreme Court ruled today that the
\nstate law allowing the Hawaii Superferry to
\noperate while an environmental impact statement
\nwas conducted is unconstitutional.<\/p>\n
The Sierra Club had argued that Act 2, a law
\npassed by the state Legislature in special
\nsession in October 2007, is unconstitutional
\nbecause it was targeted to benefit just one
\nentity, the Hawaii Superferry. Act 2 allowed the
\nSuperferry to provide Honolulu-to-Kahului service
\nwhile the environmental study was done.<\/p>\n
A Superferry spokeswoman had no immediate comment
\non the court’s decision. Sierra Club officials
\npreviously said if the ruling is in their favor
\nthe Superferry would have to cease operations
\nuntil the EIS is completed, a process that could
\ntake months.<\/p>\n
